With the exception of violation VTL 1180a, the amount of points assessed to a driver’s license is based on the amount of miles per hour over the speed limit the motorist is convicted of.

VTL 1180-(a) Speed not reasonable and prudent.

VTL 1180-(a) is not based on a exceeding a speed limit, but rather based on the idea that the motorist was driving too fast under the circumstances. An example would be traveling 40 miles per hour in a 45 mile per hour zone during a rain storm. Even though you may have been traveling under the speed limit, the officer may allege that you were driving too fast under the circumstances and thus your speed was unreasonable or imprudent.

In many jurisdictions throughout New York State it is possible to have a Speeding Ticket dismissed or reduced. It is always best to avoid a speeding ticket conviction if at all possible. In addition to the points, fines, surcharges and insurance premium increases associated with a conviction to a speeding ticket, a conviction for a 6 point, 8 point, or 11 point speed, will always result in the imposition of a driver assessment fee. A conviction for a lesser speed, such as a 3 point or 4 point speeding ticket may also result in the imposition of a driver’s assessment fee if the motorist already has points on his or her license or DMV record, for offenses that occurred within 18 months of the speeding ticket offense. The NYS driver assessment fee starts at $300 for those who receive 6 points on their license within an 18 month period, The driver assessment fee is payable over 3 years, $100 per year for 3 years with an additional $75 assessment for every point over 6 points also to be paid for over a period of 3 years. A conviction to 3 speeding tickets in New York State, with dates of violation within an 18 month period of each other will result in a license revocation of 6 months.
