While there are over 25 different types of license violations under the New York State Vehicle and Traffic Law, most license violation tickets issued in New York are for either VTL 509.1, Driving Without a License, VTL 511.1, Aggravated Unlicensed Operation in the 3rd Degree, often referred to Driving with a Suspended License, and VTL 511.2A Aggravated Unlicensed Operation in the 2nd Degree.
While driving without a license (VTL 509.1) is a traffic infraction, not a misdemeanor, there is a growing trend in a number of courts, such as the Nassau County Traffic and Parking Violations Agency (Nassau County TVA) and at the Suffolk County Traffic and Parking Violations Agency (SCTPVA), to seek incarceration for those convicted of driving without a license with a history of such convictions.
