In New York State, a conviction for any moving violation will lead to points being assessed to your driver’s license or driving record. For this reason points should be avoided, or at least attempted to be reduced whenever possible. Points may lead to a DMV Drivers Assessment fee being imposed, increased insurance premiums, as well as a suspension of your driving privileges. New York Traffic Lawyers are familiar with the nuances of each of the courts they practice in and will always attempt to have your ticket dismissed. When a dismissal is not possible, the traffic attorney will then attempt to have the violation reduced to a lesser violation with fewer points. The exception is with traffic tickets returnable to the New York State Traffic Violations Bureaus located in Brooklyn, Queens, Staten Island, Manhattan, Bronx, Staten Island, Buffalo, and Rochester New York. Here the courts do not permit negotiations. Usually the cases must be tried, with either a finding of guilty or not guilty from the court. Borderline speeding tickets, one or two miles over the designation point level, such as a 71 mph in a 50 mph zone, or 86 mph in a 55 mph zone, will often be reduced 2 points with an attorney after trial, however there is no plea bargaining in these courts.
