If you received a speeding ticket or other moving violation while driving in New York State, you are not alone. New York State Troopers and local law enforcement issue approximately 680,000 speeding tickets annually in New York State. When other moving violation tickets are factored in, the total number of traffic tickets issued in New York State is astounding. Manhattan, Queens, Nassau County, Suffolk County and Westchester account for a large portion of the tickets issued within the state.
While receiving a speeding ticket or other moving violation can put a damper on your day, the good news is that every year thousands of drivers are able to get their tickets dismissed or reduced to 0 points by retaining a traffic lawyer to assist them with their case. These are attorneys who concentrate on handling traffic ticket cases. Traffic lawyers tend to concentrate on cases in specific locations and courts. It’s best to consult with a traffic lawyer that practices regularly in the court where the ticket is returnable to. If you received a speeding ticket in Southampton, NY, it’s best to consult with a Southampton Traffic Lawyer. If you received a speeding ticket in Brooklyn, it’s best to speak with a Brooklyn Traffic Lawyer. It’s important to understand that all counties, villages, and courts differ in the way in which speeding tickets and traffic violations are prosecuted. Local attorneys are familiar with the judges, prosecutors, and court staff. They understand the nuances of each of the courts they regularly appear in. A Suffolk County Traffic Lawyer will know how to navigate a Suffolk traffic ticket through the Suffolk County Traffic and Parking Violations Agency in Hauppauge, once considered by many to be one of the most difficult courts in New York State, as well as the First District Court in Central Islip. For tickets issued in Kings County, a seasoned Brooklyn Traffic Lawyer will generally have already conducted numerous trials with the officer who issued the ticket.
While the New York State Vehicle and Traffic Law contains many different types of violations, the majority of tickets issued by the police and New York State Troopers are for speeding, crossing over hazard markings, unsafe lane change, cell phone violations, portable electronic device violation, suspended license, HOV violations, failing to signal, passing a stop sign, red light violations, failing to yield, failing to yield to an emergency vehicle, reckless driving, revoked registration, trucking violations, driving while intoxicated, driving while ability impaired due to drugs and tickets for no insurance.
New York Traffic Lawyers are familiar with the courts they regularly appear in. A traffic attorney will always try to have the ticket dismissed or reduced to 0 or minimal points. Traffic lawyers can usually negotiate a resolution avoiding the risks associated with trying the case. In certain courts, such as the New York City Traffic Violations Bureau’s negotiated settlements are prohibited. Consequently, for the best resolution, most tickets returnable to the city Traffic Violations Bureau’s must proceed to trial. For this reason, traffic lawyers handle New York City traffic differently than tickets issued outside the city. For example, a Queens Traffic Lawyer needs to be present at the Traffic Violation Bureau on each court date, at the specific time the case is scheduled for. The attorney then needs to decide whether to proceed to trial or to request an adjournment. Queens Traffic Lawyers concentrate on defending traffic tickets at the Queens TVB and often station themselves at one of the Traffic Violations Bureau’s all day handling numerous cases during each of the scheduled court sessions. Other counties are handled differently. A Nassau Traffic Lawyer can almost always negotiate a resolution with the prosecutor.
In Suffolk County most traffic tickets are returnable to the Suffolk County Traffic and Violations Agency, which at one time was considered one of the most difficult courts in the state for attorneys to represent clients in. That has changed, and today a Suffolk Traffic Lawyer can usually get speeding tickets and other traffic violations substantially reduced. Misdemeanor cases such as driving with a suspended license and DWI cases are usually returnable to the Suffolk County First District Court in Central Islip. Likewise, Suffolk Traffic Lawyers can generally be very effective in obtaining favorable resolutions on cases at the First District Court. Unlike Long Island and the 5 boroughs, Westchester County does not have a centralized traffic court, but rather multiple village and town courts. Motorists who have received a Westchester speeding ticket or a Westchester traffic ticket should consult with a Westchester traffic lawyer. They represent motorists in the numerous courts located throughout the county and are familiar with the Westchester Courts.
When dealing with a traffic ticket, it is best to retain an attorney as soon as possible, or at least, to consult with an attorney early on. The reason is as soon as a ticket is issued, the time to file certain demands and motions begins to run. Consequently, there are advantages to hiring a traffic lawyer early in the process. In some courts there may be an opportunity to have the ticket or tickets dismissed by filing a request for specific documents. In certain situations, if the police fail to respond, or fail to respond properly, a motion can be made requesting the ticket or tickets be dismissed. Some requests need to be made within 30 days of the return date listed on the ticket. If the request is made after that date, an opportunity to have the ticket dismissed may be lost.
